How we calculate (methodology)

Article 84: half a month's wage per year for the first five years + one full month's wage per year after, based on the last wage, with pro-rata for partial years.

Article 85 (resignation): under 2 years = nothing | 2 to 5 = one-third | over 5 to 10 = two-thirds | 10+ = full.

Article 87 (exception): full award when leaving due to force majeure, or for a female worker within 6 months of marriage or 3 months of childbirth.

Wage note: the law uses the last actual wage (basic + fixed allowances like housing/transport). Variable commissions may be excluded by agreement (Art. 86).

FAQs

I resigned after 1.5 years — do I get anything?
No. Under Article 85, resignation before completing two consecutive years earns no end-of-service award.
My employer terminated me after 3 years — how much?
The full award with no reduction (Article 84 only): half month × 3 years = 1.5 months of your last wage. Article 85 ratios apply to resignation only.
When must the employer pay the award?
Within one week of the end if the employer ended it, within two weeks if you ended the contract (Article 88).
What if my employer calculated on basic salary only?
The law says last wage including fixed allowances. If the difference is large, check with your HR or file with the Labor Court.
